Terms of service
1. About these terms
These Terms of Service ("Terms") govern your use of the Bike the Gorge online store at bikethegorge.myshopify.com and any purchase you make through it (the "Store"). The Store is operated by Bike the Gorge LLC, an Oregon limited liability company located at 15 NE Herman Creek Ln, Suite 101, Cascade Locks, Oregon 97014 ("Bike the Gorge," "we," "us").
By browsing the Store, creating an account, or placing an order, you agree to these Terms, our Refund Policy and our Privacy Policy, which are part of these Terms. If you do not agree, please do not use the Store.
The Store runs on Shopify. Payments are processed by Shopify and its payment partners, and your use of their services is also subject to their terms.
2. Eligibility and accounts
You must be at least 18 years old, or the age of majority where you live, to place an order. A parent or guardian may purchase products for a minor and is responsible for that minor's use of them.
If you create an account, keep your login details confidential and give us accurate, current information. You are responsible for activity under your account. We may suspend or close an account that is used fraudulently or in violation of these Terms.
3. Products, pricing and availability
We try to describe and photograph products accurately, but colors, specifications, range, top speed and battery performance come from manufacturers and vary with rider weight, terrain, temperature and settings. Manufacturers may change specifications without notice.
All prices are in U.S. dollars. Products are subject to availability, and we may limit quantities. If a product is listed at an incorrect price or with incorrect information because of an error, we may cancel any order for it, even after confirmation, and will refund any amount charged.
Online price match. We will match the manufacturer's own current advertised online price or promotion for the same model, size and configuration, sold new by that manufacturer to U.S. customers. Price match does not apply to third-party retailers, marketplace sellers, clearance or open-box items, bundled offers, or errors. Requests must be made before purchase. We decide eligibility at our discretion.
4. Orders and payment
Your order is an offer to buy. We accept it when we confirm the order or fulfill it. We may refuse or cancel any order, for example for suspected fraud, an error in price or availability, or a failed payment, and will refund any amount charged for a canceled order.
We accept the payment methods shown at checkout. By submitting payment, you confirm you are authorized to use that method. Applicable sales taxes and government-imposed fees are calculated and shown at checkout before you pay.
An Environmental Battery Recycling Fee is charged on all e-bikes and spare batteries that are included in the Battery Network's battery recycling program. This $15 fee is listed on the description page of all applicable products and shown at checkout before you pay.
5. Pickup, delivery, shipping and assembly
In-store pickup. E-bikes include free professional assembly and fitting. We will contact you when your bike is ready. Please pick up within 14 days of notice, or we may cancel the order and refund it less any restocking fee allowed by our Refund Policy.
Local delivery. Local delivery is available only to the ZIP codes offered at checkout. Someone 18 or older must be present to accept delivery. Delivery dates are estimates.
Shipping. Where shipping is offered, delivery times are estimates and we are not responsible for carrier delays. Inspect your package on arrival and report visible damage or missing items within 5 days.
Risk of loss. Risk of loss passes to you when you pick up the product, when we hand it to you at delivery, or when we hand it to the carrier, whichever applies.
Assembly done elsewhere. If you assemble, adjust or modify a product yourself or have someone other than us do it, we are not responsible for that work or any damage or injury it causes.
6. Returns, exchanges and refunds
Returns, exchanges and refunds are governed by our Refund Policy. In summary:
- E-bikes, mountain bikes, vehicle racks, gift cards, service plans, and parts installed on a customer's bike are non-refundable.
- E-bikes, mountain bikes and vehicle racks in good working condition may be exchanged for products of equal or greater value within 14 days of purchase, subject to inspection and a $100 restocking fee.
- Unused parts, accessories and components in original packaging, and apparel, may be returned within 30 days for a full refund.
If this summary and the Refund Policy differ, the Refund Policy controls. Nothing in these Terms limits your rights under a manufacturer's warranty or under applicable law, including for defective products.
7. Warranties
Manufacturer warranties. E-bikes, batteries, motors and most accessories carry the manufacturer's own written warranty, if any. Its terms, length and exclusions are set by the manufacturer, not by us. We will help you start a warranty claim for products bought from us, but the manufacturer decides whether to approve it. Warranties are commonly voided by modifying speed or power settings beyond the manufacturer's limits, using non-approved batteries or chargers, commercial use, or improper repairs.
Our disclaimer. Except for any written warranty we give you, and to the fullest extent permitted by law, products are sold "as is," and we disclaim all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. Where the law does not allow implied warranties to be disclaimed, including where you also bought a service plan from us, implied warranties are limited to the length of the manufacturer's written warranty or the shortest period the law allows.
8. E-bike safety and legal use
Riding a bicycle or e-bike involves inherent risks, including serious injury or death, from falls, collisions, road and trail conditions, weather, mechanical failure, and other people. You choose to ride, and you accept those risks to the extent the law allows.
You are responsible for:
- Reading and following the manufacturer's owner's manual, including battery charging, storage and transport instructions.
- Following all laws where you ride, including minimum rider age, helmet, speed, lighting and trail-access rules. These vary by state, city and land manager, and some trails prohibit e-bikes.
- Keeping speed and assist settings within what is legal where you ride. Some models can be configured above 20 mph; doing so may change how the bike is classified under local law.
- Not modifying the motor, controller, battery or speed limits. Modifications can create fire and crash hazards and usually void the warranty.
- Supervising any minor who uses a product you buy, and making sure they meet age and helmet requirements.
- Keeping the bike maintained, especially brakes, tires and battery, and having it inspected after a crash.
Lithium-ion batteries can catch fire if damaged, improperly charged, or used with non-approved chargers. Stop using and contact us or the manufacturer if a battery is swollen, damaged, overheating or leaking.
9. Rentals, tours, test rides and service
These Terms cover the online store. E-bike rentals, tours and complimentary test rides are booked through our third-party booking provider and are governed by the rental agreement, release of liability and booking terms you accept at booking or check-in. Service and repair work is governed by the work order and service terms you accept when you drop off your bike.
Service plans. Service plans sold in the Store cover only the services described on the product page, for the stated term, on the bike registered to the plan. They are non-transferable unless the product page says otherwise, are final sale, and do not cover parts, crash damage, or damage from misuse or modification unless stated.
10. Promotions and gift cards
Discount codes and promotions apply only as stated, cannot be combined unless stated, have no cash value, and may be changed or ended at any time without affecting orders already placed. We may cancel orders that use codes obtained or applied improperly.
Gift cards do not expire and carry no fees. They can be used for Store purchases and in-store purchases and cannot be redeemed for cash except where required by law. Treat a gift card like cash; we are not responsible for lost or stolen cards.
11. Reviews and acceptable use
If you post a review, photo or other content on the Store, you confirm it is your own honest experience and that you have the right to share it. You give us a non-exclusive, royalty-free license to display and share it in connection with our business. We may remove content that is false, offensive, unlawful or off-topic. We do not edit reviews to change their meaning.
You agree not to use the Store to break the law, place fraudulent orders, interfere with the site's security or operation, scrape or copy content in bulk, upload malicious code, or impersonate anyone.
12. Intellectual property and third parties
The Store's content, including our name, logos, Go Gorge marks, text, photos and design, belongs to Bike the Gorge LLC or its licensors. Product names, images and trademarks belong to their manufacturers. You may not copy or reuse Store content for commercial purposes without our written permission.
The Store links to third-party sites and services, including our booking provider and manufacturer websites. We do not control them and are not responsible for their content, terms or privacy practices.
13. Limitation of liability and indemnity
To the fullest extent permitted by law, Bike the Gorge and its owners, employees and agents are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising from the Store or products bought through it. Our total liability for any claim related to an order will not exceed the amount you paid for the product involved.
These limits do not apply to liability that cannot be limited by law, including liability for death or personal injury caused by our negligence, or for fraud.
You agree to indemnify and hold us harmless from claims, losses and costs, including reasonable attorney fees, arising from your misuse or modification of a product, your violation of these Terms, or your violation of law.
14. General terms and contact
Governing law and disputes. These Terms are governed by Oregon law, without regard to conflict-of-law rules. Before filing a claim, please contact us so we can try to resolve it informally within 30 days. Any lawsuit must be brought in the state or federal courts serving Hood River County, Oregon, except that either party may bring a qualifying claim in small claims court.
Changes. We may update these Terms by posting a new version with a new effective date. Changes do not apply to orders placed before the update.
Other terms. If any part of these Terms is unenforceable, the rest remains in effect. Our failure to enforce a term is not a waiver. These Terms, with the Refund and Privacy Policies, are the entire agreement between you and us about the Store.
